Terms, Conditions and Expectations:
These are the terms, conditions and expectations that form the working agreement between the customer herein referred to as "Immigration Consultant / Customer" and the consultants working with www.thebizplan.company herein referred to as "the Consulting Group".
In rare occasions, there may be disagreements over the expectations of the client and the ability of the consulting group to satisfy those expectations.
1. We do not work for free. A $2,000 plan represents in total an expectation of less than 35 hours of work for the Consulting Group. On occasion we do work more than that, and, even as experienced researchers and plan writers, we always produce as effectively and efficiently as we can. However, there are clients in the past whose expectations have been for Consulting Group members to work in the range of minimum wage. This is not realistic or an intelligent expectation.
1a) If successive edits become numerous (more than 2 or 3), there will come a point, at the sole discretion of the Consulting Group, where 'no additional edits without prepayment' becomes the policy.
1b) Although in some situations "foreign labour" may be able to produce plans for less investment, so far, after 20+ years, we have not seen a plan match ours, while charging less than we do. However, this is a free market and Consultants and Clients are free to spend their money wherever they choose.
2. Guarantees: We can not guarantee the success of any plan, since we have no control over the personal situation of an applicant (background checks / verifications), nor over the Assessors on the Canadian-side of any given application. It is a reality we all have experienced that two, very similar plans will meet with opposite outcomes. What we do offer is:
2a) If a plan we write is refused, we will adapt it "free of charge" for a different jurisdiction (same business, but different Province).
2b) If a plan we write is refused, and the applicant chooses to pursue a DIFFERENT BUSINESS, in a different jurisdiction, we will write the new plan, for a different business, in a different jurisdiction, at "cost". Although this is a rare instance, we have, on three separate occasions in two decades, done this for clients. The cost varies according to the new business type, but "to-date" has not been more than 67% of the old plan's cost.
3. Providing documentation: As the Immigration Consultant or Client, you are accepting full responsibility to respond to our inquiries in a timely fashion (Expected: 24 business hours; Outside: 48 business hours). Our commitment to you is to create the draft of the plan within 10 business days. However that is only if the critical information is provided in the same timely fashion. Caveats include:
3a) If we have to wait for your information, we stop the clock. For example: on "Day 4" we request additional information. Consultant / Client responds on Day 7.... We are only on "Day 5, the day after receiving that information.
3b) If we require information from Agencies (Government / Private, etc.), and those information sources delay transmitting that data, our clock is extended by the length of time we wait to receive the data.
3c) On rare occasions the Consulting Group may have members either ill or injured (Ex: traffic accident). If those unforeseen circumstances occur, while we will endeavor to find replacement contractors as quickly as possible, it will inevitably cause delays while the recovery of the Consulting Group member occurs, or while the replacement consultant is brought "up to speed" on the project.
4. Payment: Payment is usually made in "2 parts": (1) You pay a 50% deposit prior to work beginning, and (2) you pay the final 50% after approving the final draft of the plan, and before receiving the "un-watermarked" version of the plan.
5. Disagreement and Termination: If for some rare reason there is a decision by either the Consulting Group or the Immigration Consultant / Client, then the following will occur:
5a) The Consulting Group may provide the amount not already consumed by already-completed research and writing, back to the Immigration Consultant / Client, minus any transaction costs (the costs charged by the banking or credit card clearing facilities used).
5b) The Consulting Group at its sole discretion may provide the deposit back to the Immigration Consultant / Client, minus any transaction costs (the costs charged by the banking or credit card clearing facilities used).
6. Upon payment of the Deposit, you are contractually agreeing to having the consultants working with www.thebizplan.company (the Consulting Group) work on and deliver a completed business plan, and you also agree that you will complete both the Deposit and the Final Payment, each of which are 50% of the agreed-upon price. You also agree to be bound by any additional costs or revised prices that you have been presented with, prior to those additional costs being incurred by the Consulting Group. Failure to pay the Final Payment will result in the use of a Collection Agency, and the Immigration Consultant / Customer agrees that the legal jurisdiction for any legal action or court dates, will be the Province of Saskatchewan.
